EVOLVING ROLE OF ARBITRATION

“An enabling alternate dispute resolution ecosystem is a national priority for India. We need to promote India globally as an arbitration hub. Availability of quality arbitration mechanisms is an integral component of Ease of Doing Business, to which our Government is committed.”

Shri Narendra Modi

Hon’ble Prime Minister of India

“India is no longer merely a user of arbitration; it is increasingly becoming a thought leader and an intellectual contributor within the global arbitration community.”

Hon’ble Mr. Justice Surya Kant

Chief Justice of India

“Looking at the alternative dispute redressal mechanism, the government is institutionalising arbitration within India so that commercial dispute settlements which are happening through arbitration outside India will come back to India when dealing with Indian commercial interests.”

Smt. Nirmala Sitharaman

Minister of Finance and Corporate Affairs

"India will become an arbitration hub. We have people going to Singapore and London for arbitration. Why should they go there when they can do it here?"

Arjun Ram Meghwal

Law Minister

“In a world where time is of the essence and certainty is of paramount importance, arbitration is recognized as the cornerstone of modern dispute resolution.”

S. Jaishankar

EAM

With increase in cross-border trade and commerce, commercial and contractual disputes have exponentially increased among the parties across the world. In order to ensure smooth work flow and avoid loss of time, business and money, parties require that these commercial disputes are resolved through a robust dispute resolution mechanism that ensures justice, cost-effectiveness and timely resolution. For resolution of these commercial disputes, arbitration has now become the most preferred option for the parties and hence, there is an exceptional increase in the number of disputes being referred to and resolved through arbitration. Consequentially, ‘arbitration as a service’ is emerging as one of the fastest growing sectors in the domain of alternate dispute resolution.

Dispute resolution is one such aspect of corporate affairs that has a serious impact on seamless operations management and workflow processes of corporate entities. A systemic approach is thus needed to address commercial dispute resolution for enabling businesses to focus on their core competencies. I am glad to introduce this ‘IICA Certified Arbitration Program’ to build and strengthen the arbitration ecosystem through training and capacity building. I wish all the participants a great learning experience ahead.
